It is already in the news that Lagos State government has concluded
plans to introduce monthly rent payment for Housing schemes to help the
low income earners. It is pertinent to know some basic Lagos Tenancy Law
for Lagos residents or people who intend to reside in Lagos State. The government of Lagos state has perfected plans to make residents in the state pay rents per month rather than yearly or half-a-year as has been the case for decades.
The Lagos Tenancy Law 2011 provides that it is unlawful for a landlord or his agent to demand or receive from a new or prospective tenant, rent in excess of 1 year in respect of any premises; it is also unlawful for the new or prospective tenant to offer or pay rent in excess of 1 year. The penalty for both landlord and tenant involved in such an arrangement is a fine of N100,000 or to 3 months imprisonment.
As a tenant of a property, if you get your landlord’s consent in writing to make some improvements on the premises, and the landlord ends the tenancy. You are entitled to claim compensation/ reimbursement for the improvements that you made, when you are quitting the premises.
The Lagos Tenancy Law 2011 does not apply to premises in Apapa, Ikeja GRA, Ikoyi, and Victoria Island.
If your landlord, is trying to eject you as a tenant from the property, demolishes or alters the building without court approval; or threatens or molests you, or attempts to remove you by force from the property, the landlord is committing an offence and is guilty if convicted to a fine of N250,000 or a maximum of 6 months imprisonment.
The Lagos State Tenancy Law 2011 provides that parties can provide for how a notice to quit can be given in the tenancy agreement, however, when there is no such provision, Section 13 of the law provides that:- Where there is no stipulation as to the notice by either party to determine the tenancy, the following shall apply –
* A week’s notice for a tenant at will
* One (1) month’s notice for a monthly tenant
* Three (3) month’s notice for a quarterly tenant
* Six (6) month’s notice for a yearly tenant.
It’s important to note that when the tenancy is for a fixed period (e.g. one year) and such period has expired but the tenant refuses to give up possession, if the landlord intends to recover possession, he shall serve a seven (7) days written notice of his intention to apply to recover possession.

only landlords that only survive through tenancy fees @Muyiwa: Yeah. I

scheme, only tenants under the umbrella of the scheme
