THE Supreme Court on Friday ordered Mohammed, son of the late military head of state, General Sani Abacha, to return to the high court to face his trial.

Mohammed has approached the apex court seeking to upturn the decision of the Court of Appeal which mandated the Federal Government to recover alleged funds looted by the late head of state.

The Federal Government had slammed a123-count charge bordering on conspiracy, receiving of stolen funds, among others, on Mohammed before an Abuja high court.

Before taking his plea at the trial court, Mohammed approached the Court of Appeal contesting the legality of his trial on the grounds that he had complied with the provisions of Forfeiture of Assets (Certain Persons) Decree No. 53 of 1999.

He had told the court through his counsel, Joseph Daudu (SAN), that insofar as he complied with the provisions of the said decree, no criminal or civil suit could be instituted against him.

But in its judgment, the appellate court resolved the appeal in favour of the Federal Government, saying that there was nothing in the provision of the decree which inhibits the high court from exercising its judicial power to try Abacha.

Justice Amina Augie, who read the lead judgment of the court, also held that the decree did not resolve any criminal issues sought to be determined in the high court of Abuja.

The court held further that the said Decree No.53 did not confer any immunity on Mohammed Abacha.

Delivering judgement in the appeal at the apex court, Justice Oluwakayode Ariwoola held that Mohammed should return to the trial court to take his plea and possibly plead a no-case submission, if he so wishes.

The court further held that if the late Abacha were to be alive today and had left office, he would be liable to prosecution.

It also held that the appellant was charged with offences against the state and the forfeiture order was just a punishment which could not earn him indemnity against trial.

According to the court, the immunity of the father could not work for the son and even the immunity of the father expired at his exit from office as provided by Section 308 of the 1999 Constitution.

“The appellant’s father is not the one on trial. His immunity cannot extend beyond his stay in office.

“The late Abacha is not on trial, therefore, the appellant should go and face his trial. He cannot enjoy the immunity of the father.

“The April 18, 2005 judgment of the Court of Appeal is hereby upheld.

“The appeal is hereby dismissed as unmeritorious and vexatious,” the court held.

2014 promises to be an exciting year for the music industry.

It is 2014 already and the Nigerian entertainment industry, particularly the music sector, is gearing up for a busy year. With some artistes failing to release their anticipated album in the previous year -2013, we expect loads of albums in 2014. NIGERIA MUSIC PLANET takes a look at singers whose albums will most probably be released this year.

WizKid
Star Boy and EME artiste, Ayo ‘Wizkid’ Balogun, whose second studio album was postponed thrice in 2013, is expected to release the anticipated musical work this year. Expected to be loaded with international and local collaborations, and top notch productions from top producers, Wizkid’s yet-to-be titled second album might go the way of the first album; an all hit musical work.

Wande Coal
Remember he trended worldwide on social network, Twitter, when he released three singles back in 2011. Wande who ended the year 2013 with a Glo endorsement deal after a split with his former label boss, Don Jazzy, is expected to release his second long awaited album under his Black Diamond imprint.
D’Banj

After winning Headies ‘Next Rated’ awards, the Difference Entertainment artiste who broke into the mainstream music industry in 2013 with his hit single, Sho Le, and subsequent singles Mama e and Komole, will seek to test his feet more in the music waters with a full studio album which is expected to be backed with production from D’tunes.

Praiz
X3M music alternate artiste and MTN ambassador, Praiz, who had a decent 2013 with his multiple awards winning ‘Rich and Famous’ single is expected to release his debut album this year if tweets by his label boss, Steve Babaeko is any to go by.

Doctors at the University of Gothenburg Sweden have successfully carried out womb transplant for 9  women who were born without a womb and are waiting for them to get pregnant. This amazing new kind of surgery is geared towards helping women who are born without wombs, a medical condition called MKRH or had there uterus removed due to severe medical conditions such as cervical cancer.

The wombs received were from mothers or female relatives of the recipients. All nine women are currently ovulating which is a good sign that the wombs are doing fine inside the women.

Rev. Okotie, nursing a strong presidential ambition , announced his intention to become Nigeria’s number one citizen in 2015.

In a exclusive interview with The Punch, Rev. Okotie said he will run in 2015, God willing.

“God spoke to me about my participation in the political process, which was why I took the step in the first place. He has not said anything contrary.’’, Rev. Okotie said.

When he was reminded that he had always lost every election he took part in by the reporters, Rev. Okotie explained that he had lost those elections as a result of election malpractices carried out,

He said, “I can sum it up in one word-rigging by the PDP. Even one of the party’s stalwarts, Chief Adeseye Ogunlewe, told The PUNCH recently that all elections have always been rigged. So that answers the question.

“These election questions are inter-related. If they didn’t rig, then I could have won. Apart from election malpractices, the duty of a servant of God is to obey his master when he gives him instructions, irrespective of whether he fails or succeeds. Like Moses in the Bible, who kept fighting until Pharaoh released the Israelites.’’

Meet  9-Year-Old Girl Who Succeeded in Her WAEC Exams

A 9-year-old prodigy girl, Anjola Victoria, has passed her WAEC exams the November/December 2013 West African Examination Council (WAEC).

What was your experience during the period of GCE exams?
I studied a lot during the period of the exam. I even had to study books that were for SS3 students. I also studied the oldest past questions of the GCE examination that I could lay my hands on because the older the questions, the harder they are.

How did you register for GCE considering your tender age?
I burst into tears when the computer rejected me as being too young to register for GCE. I had to increase my age by five years before I could register for the exam.

What was the impression of other candidates at the exam centre?
No one believed that I was a candidate let alone give me the opportunity to write the exam; not even

the examiners allowed me into the exam hall until I passed the biometric test. Some candidates were mocking me, others called me names “over-ambitious girl, wait for your time”. 

 

What was your Exam registration number?
My Exam number was 5250802098.

How old were you when you registered for the exam?
I was eight years old when I was preparing for the exam. I was eight when I wrote the French Oral exam then I clocked 9 before I wrote the English exam.

What was easy and what was very hard?
It was actually easy but the difficult part of the English exam was the summary aspect.

What were your grades in the exams?
I registered for seven papers but only wrote two, English and French because I readily had teachers in those two subjects, dad and mum. I made C5 in French Language and C6 in English Language.

Did your school participate in grooming you for the examination?
My school was not aware I was writing the exam. But what I learnt from school also played a part, so in a way, my school participated.

Even my parents got to know about my registration for the exam after my brothers helped me complete the process. My parents who are both Lawyers felt it was a daring joke considering my age but decided to groom me for the exam. They had degrees in English and French respectively before reading Law.

Why did you write only English and French?
I wrote only English and French because by the time I made up my mind to register for the exams, time was not on my side. I had teachers in those two subjects only: mum and dad.

Do you speak so much French? How did you make C5 in French?
I don’t speak much French but my dad does. He had first and second degrees in French before reading Law. I am the former Miss French of my school. Every year, my school organises a French day and “Miss French” and “Master French” pageant is the main event for the day. I am always involved in any French related activity in my school. I am the current Head Girl of the school.

Was French easier than English? Why did you perform better in French than English?
French was not easier than English, but interestingly, I had more confidence than ability in French and the reverse was the case in English. I love French. I am an active member of French Club in my school. Daddy always told me Paris is a beautiful city. I heard of the famous French proverb “See Paris and die” and I wish to see it one day.

Did you receive special lessons in preparation for the exam?
Yes I did, in a way my dad who is a bilingual lawyer and a former French teacher was my French teacher and my mum who is a Chief Magistrate was my English teacher.

How did you feel when you passed the examination?
I felt very happy when I passed the exam but I was a bit disappointed by the result because I expected B2 or B3 in English Language.

Do you have a social life?
Yes I have a social life. I love dancing. I win best dancer’s competition at most birthday parties and social functions.

How do you relax?
I play games on my dad’s iPad. I relax by watching television or swimming. I also enjoy reading storybooks and science encyclopaedia.

What do you want to become in future?
My dream is to be a medical doctor in the future, if possible be the youngest medical doctor in the history of Nigeria.

What message do you have for children of your age?
I advise children of my age to cultivate the reading culture and be ready to learn and show seriousness in their studies because having the right attitude is better than hard work and knowledge. When there is a will, there is a way.

In what could prove to be a major marketing and legal embarrassment for Unilever Nigeria Limited (UNL), a 26-year-old man has filed a case against the company, which owns the Close Up toothpaste brand, for ‘cheating’ and causing him ‘mental suffering’.
The plaintiff has cited his failure to attract any girl at all even though he’s been using Close-Up toothpaste for over seven years now. Close-Up advertisements suggest that the product helps men in instantly attracting women by letting their breaths out.

Anthony Olatunfe, the petitioner, also surrendered all his used, unused and half-used Close-Up tubes to the court, and demanded a laboratory test of the products. Anthony was pushed to take this step when his female boss slapped his face when he tried to kiss her after brushing his teeth with the Close-Up toothpaste.

“Where is the Close-Up effect? I’ve been waiting for it for over seven years. Right from my college to now in my office, no girl ever agreed to even go out for a tea or coffee with me, even though I’m sure they could smell my breath. I always brush my teeth with so much close up gel to make sure the girls get turned on by my fresh breath as they usually show on TV. “

Anthony claims that he had been using the toothpaste as per the company’s instructions even since he first bought them. He argued that if he couldn't experience the Close-Up effect despite using the product as directed, either the company was making false claims or selling fake products.

“I had always stored them in cool and dry place, and kept them away from direct light or heat. I brushed my teeth morning and night. I did everything they instructed. I even beat up my 5-year-old nephew for coming near my toothpaste, as they had instructed to keep away from children’s reach. And yet, all I get is a slap from my boss.” Anthony expressed his frustration.

Unilever has officially declined to comment on the case citing the subject to be sub judice, but our sources inform that the company is worried over the possible outcomes of the case. The company might argue that Anthony was hopelessly unattractive and unintelligent and didn't possess the bare minimum requirements for the Close-Up effect to take place. Officially Unilever has not issued any statement, but legal experts believe that they could have tough time convincing the court.

“Unilever might be tempted to argue that Anthony is too ugly to attract a girl, but it is very risky. There is no data to substantiate the supposition that unattractive and unintelligent men don’t attract women. In fact some of the best looking women have been known to marry and date absolutely unattractive guys. I’d suggest that the company settles this issue out of court.” Barrister Festus Keyamo said.

Grass Eating Church Members Are Now Falling Sick!

Members of the Rabboni Centre Ministries in Pretoria, South Africa, under instruction from their pastor, Lesego Daniel, dropped to the floor to eat grass after the ‘man of God’ told them it will ‘bring them closer to God.’ (If you missed the first post, see it here)

The church members defended their pastor who has been widely criticized for this practice and said eating grass has not only brought them closer to God but also heals them of illnesses.

‘Yes, we eat grass and we’re proud of it because it demonstrates that, with God’s power, we can do anything,’ Rosemary Phetha told South Africa’s Times Live.

The 21-year-old law student says she had been battling a sore throat for more than a year, but it was healed after she ate the grass. Doreen Kgatle, 27, of Ga-rankuwa, suffered a stroke two years ago.

‘I could not walk but soon after eating the grass, as the pastor had ordered, I started gaining strength and an hour later I could walk again,’ said Kgatle. 

Latest reports say  dozens of people are now getting sick after eating grass- an image of the bathrooms show women clutching their stomach, while the men are vomiting in the sink.

The news filtered in yesterday that he'd resigned but his media aide denied it. But according to a new report by Punch, embattled national PDP chairman Alhaji Bamangar Tukur has really resigned.

A senior member of the divided National Working Committee of the party, who spoke with Punch confirmed the news today and said Pres. Jonathan will inform the meeting of the National Caucus of the party tonight in Abuja about the development.
